What about a tax free gift to buy a house in Holland?

Do you want to buy or renovate a house? And will you receive a donation for this in 2020 from your parents, for example? Then you do not have to pay gift tax on a maximum amount of € 103.643. You can apply for this in the 2020 gift tax return. Because you do have to file a tax return, even for a tax-free donation. 2019 should have been filed before March 1, 2020 however we can stil file the gift tax return for 2019 and expect no penalty if there are no gift taxes due. Conditions for tax-free donation

You are mandatory to use the money of the donation:

  • to buy or renovate your own home in the Netherlands
  • to pay off the mortgage or residual debt of your own home in the Netherlands
  • to buy the leasehold, superficies or oppression rights of your own home in the Netherlands

This exemption only applies if the recipient is between 18 and 40 years of age at the time of the donation, or has a partner between 18 and 40 years of age. The day of the 40th birthday still counts. Other tax free donation exemptions

The tax-free donation replaces all other exemptions. This means that in the same year you may not receive € 5.515 tax-free from your parents, or € 2.208 if you received the donation from someone else. Do you receive the gift from your parents? Then of the € 103.643, you may spend a maximum of € 26.457 on something other than your own home. Do you receive the donation from someone else? How do you make use of the gift exemption?
